Former ATO soldier Ivan Rusnak confirmed Nadiya Savchenko’s alibi. #FreeSavchenko

In court today, Ivan Rusnak confirmed the lawyers’ version of events that Savchenko was captured a few hours before the shelling that killed VGTRK [All-Russia State Television and Radio Broadcasting Company] journalists Igor Kornelyuk and Anton Voloshin.

A former soldier of the 80th Airmobile Brigade of the AFU (Armed Forces of Ukraine) Ivan Rusnak, speaking on Monday [January 18] at Nadiya Savchenko’s trial as a witness for the defense, confirmed the Ukrainian servicewoman’s alibi which her lawyers had put forth. According to the former soldier, on June 17, 2014 he fought against separatists from the self-proclaimed breakaway “Luhansk People’s Republic.” The APC [armed personnel carrier] Rusnak was in was hit and caught fire. Together with other AFU soldiers, some of whom were seriously hurt, he evacuated from the burning armored vehicle, retreated into the greenery alongside the road, and organized a perimeter defense to protect the wounded.

That was where Savchenko subsequently found them, as she was walking from a [previous] skirmish towards Luhansk, to conduct reconnaissance and to try to find survivors from the Ukrainian military.

“We had just lain down near Stukalova Balka, and Nadiya came upon us. I saw her first. She was walking toward us right along the ‘greenery,'” Ivan Rusnak described. “Savchenko was heading to the stricken APC, which was smoking, up ahead. Nadiya shouted at us: ‘Do not shoot, I’m one of your own!’ I saw on her a chevron in the form of a Ukrainian flag. She wore a foreign uniform, ankle boots and a green scarf on her head. I even thought it was a man at first, we have guys who wear such scarves.” According to the witness, other than a tactical vest and an automatic, Savchenko had nothing on her, including any backpacks, two-way radios or binoculars which figure in the case as evidence for the prosecution.

“Nadiya gave us first aid, bandaged the wounded, made an injection of anesthetic, told me not to remove the fragment from the neck of one of the wounded, otherwise he would bleed out,” the witness stated in response to questions from the lawyers. “After that, she came out onto the road to call and ask for help. At this time, a shot came from the ‘greenery’ on the other side of the road and wounded her in the arm. She crawled back, and bandaged herself. She said: ‘Wait here now, others will come for you,’ and then she went forward to find and help others who were wounded.”

When answering the prosecutor’s questions, Rusnak said that the meeting with Savchenko occurred at approximately 9:30 am, and some 10 minutes later she headed toward the burning armored personnel carrier, which was captured by the “Zorya [Star]” Battalion, which was led by the current head of the self-proclaimed “Luhansk People’s Republic” – Igor Plotnitsky. Thus, Rusnak confirmed Savchenko’s defense team’s version that the Ukrainian aviator was captured a few hours before the shelling that killed journalists Igor Kornelyuk and Anton Voloshin, and thus, could not have directed it [the artillery fire that shelled the journalists].

After Savchenko left the group of AFU soldiers, Rusnak amongst them, they came under dense fire from assault rifles, machine guns and grenade launchers. According to the witness, he heard a car drive by, but it did not stop. Apparently, this was the car driven by members of “Aidar” Battalion, who went to help the wounded, but did not notice the AFU fighters, and fell into an ambush, into which a few minutes later, Savchenko fell too. In the car was a backpack with the Ukrainian pilot’s documents and belongings.

Rusnak and other soldiers took refuge in a house in the village of Stukalova Balka and waited there until nightfall, at which point, without waiting for help, they independently reached the Ukrainian checkpoint. Several BMPs and tanks had been sent to their aid, but the machines were hit, and the soldiers who made their way to them crawling along the “greenery,” came under fire from anti-aircraft guns, as did the Armed Forces’ helicopters.

The session attended by the former Ukrainian soldier was very tense. Three times in a row the court rejected allowing the witness to  view a video of Nadiya Savchenko’s capture [to have him possibly identify further witnesses], which was shot by one of the militia men – Egor Russkiy, and the defendant’s sister Vira Savchenko was almost removed for her outraged outbursts. As a result, the lawyer Mark Feygin asked the court to facilitate the witness’ “safe return home to Ukraine.” “Do you have reason to fear?” – asked the judge, surprised. “Look, I personally was kidnapped and illegally taken to Russia,” Savchenko stated in response.

In addition to questioning the witness on Monday, the [defense] lawyers have filed over a dozen petitions to exclude from the case materials the prosecution’s evidence collected by First Channel operator Roman Korolenko: Anton Voloshin’s remains and the journalists’ belongings from a hotel room in Luhansk. The judge decided to consider the petitions at the next session, after they are assessed by the prosecution.

To those who, under the new law “one day in SIZO [pre-trial detention holding cell] for two,” will be released from prison:

In initiating this law in Ukraine, I understood perfectly that on one hand this is like opening a Pandora’s Box. The underworld is unlikely to start wanting to live honestly tomorrow, and it is unlikely that every thug will want to start working hard tomorrow for low pay.

But I am experiencing in myself the remnants of the Soviet system of punishment and humiliation of human beings, and not the “corrective system” as they call it, and have understood that it imprisons more innocent than guilty. I was faced with very twisted interpretations of the law in Russia, but I am sure that in Ukraine it is not much better in this regard.

I am against such a system of tribunals and until the court system of Ukraine is not reviewed and regulated using the best examples of civilized justice systems, until then no one has the right to take away freedom from people just because the “stick of the system” from the past allows it.

Now, this does not mean that there will be no Law or Justice. There will be! Only it will be fair! And the law on “one day in SIZO for two” is the beginning of judicial reform in Ukraine in general. When we learn to run trials fairly and justly, then we can put people in holding cells. After the justice system we will change the system and conditions for keeping people behind bars. Those who choose to live by crime and to enrich themselves by injustice and through the suffering of others, will serve just punishment for this.

I as well as you, Ukrainians, really need faith, faith in people. I want to believe that everyone who “falls out” (is freed from a holding cell) will be able to see their lives in a new way and will want to make an effort to make Ukraine better for everyone to live in. We really need conscious, honest, kind people and I believe that you too will join the ranks of Ukrainian patriots. Everyone is worthy of a second chance at a decent life!

Reforms in Ukraine: Parliament adopted Savchenko law – One day spent in pre-trial detention to be recorded as two days of imprisonment.

The Parliament adopted in whole a bill authored by Nadiya Savchenko, according to which 1 day spent in jail will be counted as 2 days of imprisonment upon sentencing.

A corresponding draft amendment to the Criminal Code regarding improvement in the process of pre-trial detention enrolment conditions (Number 3413), with technical and legal revisions, was supported by 255 ministers of Parliament.

In particular, this was the first legal bill introduced by member of the “Batkivshchyna” Party, Nadiya Savchenko, who is illegally held by Russian authorities in a cell in the Russian Federation.

The bill was represented by its co-author, Ivan Krulko. He stated that citizens cannot be held in custody until sentencing has been carried out, on the same basis as those already sentenced.

Other Parliament ministers pointed out that the bill aimed at humanising legislation.

They noted that prosecutors and judges often abuse their right to hold a person in custody, so that, in essence, people can stay for 5-6 years in pre-trial detention holding cells without the case against them being considered. According to supporters of the law, it will force prosecutors and judges not to abuse it otherwise they themselves will be punished.

Russian-terrorist troops in Donbas continue shelling Ukrainian troop positions and civilian objects, using small arms, handheld and mounted grenade launchers, 82 mm and 120 mm mortars, and ZU-23-2 anti-aircraft systems. During the past 24 hours, militants also deployed armored combat vehicles (on-board weaponry of BMP-1, BMP-2, and BTR-80).

Specifically, on the stretch between Pisky and the southern outskirts of Avdiivka, terrorist shelled the ATO forces’ positions almost continuously during the past 24 hours. In the vicinity of Pisky, a militant infantry group (up to 20 personnel) advanced from the direction of the Vtoraya Ploshchadka estate towards the neutral zone, took position, and, after shelling from 82 mm mortars, opened small arms and RPG fire on the Ukrainian troops’ stronghold near the unfinished highway overpass. Militants also fired from the direction of Zhobunky and the Volvo Center Donetsk [23b Sofiiska Street], from the direction of the DAP and the destroyed radar station, and from the direction of the western and northern parts of Spartak (using heavy machine guns, SGP-9’s, and AGS-17’s).

From their positions near the Yasynuvata junction, militants fired rounds from three 2B9 “Vasilek” 82 mm mortars, in the direction of the Vynohradnyki cottage estate  and Lenina Street (Avdiivka). The ATO forces’ positions in the vicinity of Krasnohorivka, Hranitne, Rozsadky, Mar’inka, and Troitske were shelled from small arms and stand-mounted grenade launchers. Four shots from a 120 mm mortar were also recorded near Krasnohorivka, coming from the direction of Staromykhailivka. In the vicinity of Hranitne, terrorists fired from [the on-board weapons of] two BTR-80’s, under cover of one AGS-17. From the direction of Mar’inka, militants used the on-board weaponry of a BMP-1 (approximately 10 shots), while a terrorist sniper group (3 snipers) operated from the same direction.

East of Novhorodske, militants fired from AGS-17’s and SPG-9’s, and used ZU-23-2 against the ATO forces’ two advanced strongholds (this was the terrorist tactical group previously recorded by the IR group near the Zalizna Balka). Militants fired on Ukrainian troop positions northeast of Novoselivka and southeast of Yurivka (east of the Verkhnotoretske – Dzerzhynsk motorway), using 82 mm and two BMP-2’s from positions west of the Horlivske reservoir (near Shyroka Balka).

In the vicinity of Zaitseve, Vodyane, and Talakivka, militants used small arms and AGS-17’s.

Near Donetsk, Russian-terrorist troops continue building up their forces and equipment on several sections of the front line, in the northwestern direction of operations. During the past 48 hours, in addition to the several armored groups already deployed in the Petrovskiy district of Donetsk, militants transferred to the same area six ACVs (mainly BMP-2) and a mortar battery (six 2B9 “Vasilek” 82 mm mortars); while new SPG-8 and ZU-23-2 details are observed at equipped positions in the Trudovski and Zhylmaidanchyk [Zhilploshchadka] districts.

Russian-terrorist troop command is transferring reinforcements to the Pervomaiske – Kalynove – Polove area. In this area, six tanks and 16 ACVs are spotted behind terrorists’ advanced positions (this equipment was transferred here without concealment, almost demonstratively).

During the past several days, militants between Lutuhyne and Bile [Beeleh] have been transferring small batches of armored equipment to the northern direction of operations: up to 20 ACVs (BMP-1, BMR-1K, MT-LB) were transferred here in the last 3 days, in stages, 2-3 units at a time.

Militant formations in the Yenakijeve direction of operations are receiving reinforcements. New positions are being equipped northwest of Panteleimonivka, near Stavky. Up to 10 ACVs, as well as several SPG-9 and AGS-17 details, had been transferred from the direction of Mykhailivka to reinforce the previously deployed unit.
